Inauguration of the Geneva Academy
On 20 September 2007, inauguration of the Geneva Academy of International Humanitarian Law and Human Rights by Madam the President of the Swiss Confederation Micheline Calmy-Rey (Speech).
 
Founded in 2007, the Academy replaces the University Centre for International Humanitarian Law created in 2002 by the University of Geneva and the Graduate Institute of International Studies (HEI). Speech by the Director of the Geneva Academy of International Humanitarian Law and Human rights, Andrew Clapham.
 
Students 2008/09 initiative of the Academy's LL.M.

Antonina OKUTA, a student of the Academy’s Master in IHL, launched a working group that will analyse the legal parameters of setting up a special tribunal for Kenya and its legal implications in particular if the matter be referred to the ICC. Professors Antonio Cassese and Paola Gaeta supervise the project. Final report (pdf)

The Rule of Law in Armed Conflicts Project is an initiative of the Geneva Academy of International Humanitarian Law and Human Rights to support the application and implementation of international law in armed conflict. Through its global database and analysis, the Project aims ultimately to report on every concerned State and disputed territory in the world, considering both the legal norms that apply as well as the extent to which they are respected by the relevant actors.

The Oxford Companion to International Criminal Justice has recently been published by Oxford University Press.  The Editor-In-Chief is Professor Antonio Cassese, and other Academy faculty have contributed chapters, including Professor Paola Gaeta.

Professor Cassese Wins Erasmus Prize
The Academy is very proud to share the news that faculty member Professor Antonio Cassese has been awarded the 2009 Erasmus Prize, along with Benjamin Ferencz. The theme of the Erasmus Prize 2009 is "International Prosecution and Trial of War Crimes and Crimes against Humanity". The Prize is awarded annually to a person who, within the cultural traditions of Europe, has made an especially important contribution to culture, society or social science in Europe. The prize money is a sum of € 150.000. The award ceremony of the Prize will take place in November 2009. Professor Cassese has generously offered to donate his prize money to the Journal of International Criminal Justice, which is now hosted by the Academy, in order to encourage young scholars.

New Publication, "Realizing the Right to Health", available now!




"Realizing the Right to Health", Volume III in the Swiss Human Rights Book series, edited by Andrew Clapham and Mary Robinson, co-edited by Claire Mahon and Scott Jerbi, will be available this month.

The book contains 40 chapters by 60 leading health care practitioners, human rights advocates, health officials, and other authorities in the international right to health movement. The chapters address various aspects of the book's eight core topics: the human rights perspective on health, prioritizing women's health, the right to health in emergencies, people and groups at risk, key health challenges, multilateral institutions and responses, the role of health care practitioners, and strengthening health care systems.

2009 Henry Dunant Prize
Ms. Géraldine Ruiz, a student from the Academy’s MAS programme of 2007-2008, has been awarded the 2009 Henry Dunant Prize for her Master’s thesis ”Elusive Law? Air Bombardment, the Principle of Distinction and Proportionality in Attack: Conceptual Challenges and Contemporary Issues”

Since 2005 the Prize has been awarded annually by the Fondation Prix Henry Dunant, together with the Academy, for a piece of exceptional academic work that contributes to deepen, strengthen and renew the ideals and commitment of Henry Dunant. Through this award, the Fondation Prix Henry Dunant and the Academy seek to motivate young people to contribute to the dissemination of the international rules protecting the victims of armed conflicts and states of emergency.

Study Trip to The Hague
On 6 and 7 May 2009, ten Geneva Academy students participated in a study trip to The Hague, the Netherlands, accompanied by Professor  Nicolas Michel and his assistant Ms. Del Mar. The trip was organized  as part of a course taught by Professor Michel at the Geneva Academy  entitled ‘The UN and the emerging culture of the end of impunity’. The students  visited three international criminal tribunals: the International  Criminal Court (ICC), the International Criminal Tribunal for the  former Yugoslavia (ICTY), and the Special Tribunal for Lebanon (STL).

The students were very fortunate to be able to meet and speak with the  following individuals: President Antonio Cassese (President of the  STL), Joeri Maas (Coordinator of the Office of Defence at the STL),  Daniel Bellemare (Prosecutor at the STL), Béatrice Le Fraper du Hellen  (Head of Jurisdiction, Complementarity and Cooperation at the ICC),  Judge Philippe Kirsch (Judge ad hoc at the International Court of  Justice and former President of the ICC), Serge Brammertz (Prosecutor  at the ICTY), and Judge Theodor Meron (Judge, Appeals Chamber of the  ICTY, and former President of the Tribunal).  They also had the opportunity to watch hearings before the Special Court for Sierra Leone, the ICC and the ICTY.

The study trip was a great success and it is hoped that it will become part of the annual programme of the Geneva Academy.
 
The Academy reached the semi-finals of the Jean Pictet Competition on International Humanitarian Law
The 21st edition of the Jean Pictet Competition on International Humanitarian Law took place in Evian on 28 March – 4 April 2009. Julie Pertusio, Caroline Simond and Marc Morel (MAS students) excellently represented the Geneva Academy of International Humanitarian Law and Human Rights. Proving their outstanding knowledge of international humanitarian law, the three students reached the semi-finals of the competition.
 
"La 21e édition du Concours Jean-Pictet fût le centre d'âpres débats quant à la qualification d'un conflit, opposant l'Etat du Fasher et le Front de libération du Beushistan (FLB), agissant en Fasher non sans l'appui soutenu du Chada, un Etat voisin. Une mission internationale indépendante d'établissement des faits (MIIEF) a tenté d'examiner les diverses violations du droit international humanitaire, mais aussi des droits de l'homme, en rencontrant au fil de la semaine un grand nombre d'ONG, les délégués du CICR présents en Fasher ainsi que les Ministres de la défense et des affaires étrangères du Chada et du Fasher. La MIIEF a également pu entrer en contact direct avec les conseillers juridiques du FLB, afin que ces derniers aient l'occasion de justifier certaines de leurs opérations militaires. Plusieurs entretiens privés entre des victimes directes du conflit et des membres de la MIIEF ont en outre été arrangés, afin d'évaluer les effets de ce conflit sur la population civile.

Suite à une semaine riche en émotions, en rencontres et en apprentissage, nous ne pouvons que conseiller aux futurs étudiants de participer à cette magnifique aventure".

Non-lethal weapons under international human rights and humanitarian law
This workshop organised by the Geneva Academy of International Humanitarian Law and Human Rights on 17–19 May 2010 was to examine the application of international humanitarian law and human rights to a range of weapons termed ‘non-lethal’. The 20 experts, who came from academia, industry, government, and research institutions, discussed the effectiveness of applying legal regulation to a fast-evolving sector of weapons that are used in riot control, prisons, mental institutions, as well as peace operations and (though so far to a limited extent) armed conflict. The event was a central component in a Geneva Academy project to look at how adequately these weapons are regulated by international law and criminal justice standards. (more...)
 
Realizing the Right to Health - International Symposium and Book Launch

Enjoyment of health is a fundamental human right, often taken for granted. Yet, for huge numbers of people around the world, this right is not a reality. Indeed, some areas lack the political will and infrastructure to guarantee the right to health. These and other issues form the substance of Realizing the Right to Health, a recently published book edited by Andrew Clapham and former UN High Commissioner for Human Rights, Mary Robinson.

To mark this publication, on 22 June, the Geneva Academy of International Humanitarian Law and Human Rights organised an international symposium to address the topic “Realizing the Right to Health: Whose Role is it Anyway?” Deputy UN High Commissioner for Human Rights, Mrs Kyung-wha Kang, delivered the keynote address, and a number of experts participated as panellists, including Len Rubenstein, Professor Mary Crewe, Professor Eibe Riedel, Professor Lynn Freedman, Iain Byrne, Gian Luca Burci, Carole Presern, and Tido von Schoen-Angerer. The Deputy High Commissioner welcomed the book as “an initiative of the highest standards, which highlights the numerous challenges to the realisation, universality and protection of the right to health, and offers rigorous analysis and arguments to counter scepticism about health as a human right.”

Panellists addressed the importance of strengthening national health systems, and the role of governments in building strong healthcare systems. They examined case studies of how they sometimes fail to do this, for example in Zimbabwe where the government has overseen the collapse of the health system and the emergence of a large-scale health crisis. They also discussed the growing importance of new global health initiatives and public-private partnerships such as the Global Fund and GAVI. Panellists addressed the role of healthcare practitioners, as well as those of civil society, pharmaceutical companies, and global development donors. A key issue was how the World Health Organisation and other UN bodies should prioritise a rights-based approach to health and how to ensure more effective global governance in this area. The importance of taking a gender-based focus was highlighted, and the case study of maternal mortality was examined, with the Deputy High Commissioner noting that “If we are serious about reducing maternal mortality and, more broadly, about tackling the great gap in women's health, a human-rights based approach must be adopted by all of us, whatever roles we play.”

Realizing the Right to Health, (Rüffer & Rub: Zurich), Volume III in the Swiss Human Rights Book series, an initiative of the Swiss Federal Department of Foreign Affairs (www.swisshumanrightsbook.com), contains 40 chapters by 60 leading healthcare practitioners, human rights advocates, health officials, and other authorities in the international right to health movement.

It describes how realising the right to health requires a strong focus on strengthening healthcare systems and transforming health systems for women. Taking a human rights approach to health means understanding the underlying social determinants of this right, as well as how to ensure the right to health is realised in times of emergency and armed conflict, and for all groups in society, including migrants and refugees, LGBTI persons, prisoners and detainees, and others. In Realizing the Right to Health leading international experts in human rights and health address issues such as access to essential medicine, HIV/AIDS, trade and health, SARS and malaria, and human rights approaches to other key health challenges. They address the role of governments, non-state actors and healthcare practitioners, the responses of multilateral institutions, and highlight some of the most promising strategies for realising the right to health.

Signature of the first agreement between academic representatives and Defence Counsels of the International Criminal Court for the former Yugoslavia (ICTY) and the Special Tribunal for Lebanon (STL).
Geneva Academy of International Humanitarian Law and Human Rights, the International Law Unit of the Graduate Institute and the University of Geneva, on 5 October 2009 signed an agreement with the Defence Counsels of the International Criminal Court for the former Yugoslavia (ICTY) and the Special Tribunal for Lebanon (STL) establishing a Law Clinic in International Law. Under this agreement, students from the three academic institutions will conduct research to assist lawyers representing individuals charged with war crimes appearing before these two courts. New premises for the ADH

In September 2009 the Geneva Academy of International Humanitarian Law and Human Rights moved to the newly renovated Villa Moynier. The Villa Moynier is situated in the Parc Mon Repos, a few hundred metres away from Villa Barton, the current headquarters of the Graduate Institute. Over the last year, the Villa Moynier has been undergoing important renovation work funded by the City of Geneva and the Swiss Confederation; some CHF 3.7 million was used to restore this building which bears the name of one of the founders of the International Committee of the Red Cross.

The staff of the ADH are enjoying setting up in the Academy's new home, but we ask for your patience as our phones, faxes and other facilities are gradually unpacked and we get back to full operations.

Commemoration of the 60th anniversary of the Geneva Conventions
This week marked the 60th anniversary of the Geneva Conventions. Andrew Clapham, Director of the Academy and Professor of International Law at the Graduate Institute, and Gilles Giacca, researcher at the Academy, spoke to media to explain the significance of this event and the state of international humanitarian law today.  Read the full story (in french) here.

2010 simulation exercise for students enrolled in the MAS in International Humanitarian Law at the Geneva Academy of international humanitarian law and human rights (ADH)

This year’s ‘simulation exercise’, an annual activity for students enrolled in the MAS in International Humanitarian Law at the Geneva Academy, took place at the Palais des Nations, the European headquarters of the United Nations in Geneva.

Assisted by interpreters from ETI (School of Translation and Interpretation at the University of Geneva), the Geneva Academy students were asked to advise the United Nations Secretary-General, a role played by Professor Nicolas Michel, on the arrest warrant issued by the International Criminal Court against President Al-Bashir. Students played the roles of high-level civil servants of the United Nations (Heads of Departments of the UN Secretariat, UN Legal Counsel, UNHCR, OCHA, etc.), State representatives (from the five permanent members of the Security Council), and representatives from both regional and non-governmental organisations (ICTJ, Human Rights Watch, etc.). At the end of the day, after difficult discussions and negotiations, students put forward proposals for a draft of a statement by the Secretary-General, in the hypothetical case that he would be invited to participate in a debate in the Security Council about the consequences of the arrest warrant for international peace and security in Africa.

The simulation, which was held on 16 April 2010, was organized under the responsibility and supervision of Professor Nicolas Michel, with the collaboration of Mr. Steve Wilkinson, and with the assistance of Ms. Katherine Del Mar. The Geneva Academy would like to thank the School of Translation and Interpretation (www.unige.ch/eti) and the Geneva International Model of United Nations (www.gimun.org) for their generous assistance, as well as the United Nations Office at Geneva for their availability and hospitality.
